2nd STORY Official Online Store Terms of Use
These Terms and Conditions of Use (hereinafter referred to as the “Terms and Conditions”) shall apply to the use of the 2nd STORY Official Online Store (hereinafter referred to as the “Company”). This Terms of Use (hereinafter referred to as the “Terms”) applies to the online shop (hereinafter referred to as the ‘Service’) provided by 2nd STORY Official Online Store (hereinafter referred to as the “Company”) on this website. (hereinafter referred to as the “Company”) provides on this website (hereinafter referred to as the “Service”). All registered users (hereinafter referred to as “Users”) are subject to the terms and conditions of this Agreement. Registered users (hereinafter referred to as “Users”) are requested to use the Service in accordance with these Terms of Use.
1. Application
These Terms of Use shall apply to all relationships between the user and the Company concerning use of the Service.
In addition to the Terms of Use, the Company may establish various rules and regulations regarding the use of the Service (hereinafter referred to as “Individual Regulations”). In addition to the Terms of Use, the Company may also establish various rules for the use of the Service (“Individual Regulations”). Regardless of the name by which these Individual Regulations are called, they shall constitute a part of these Terms of Use.
In the event that any provision of these Terms and Conditions conflicts with the provisions of the Individual Regulations set forth in the preceding paragraph, the provisions of the Individual Regulations shall take precedence unless otherwise specified in the Individual Regulations.
Personal information will be handled only within the scope of the purpose of use, which is specified for each business or campaign and notified to users.
Provision and disclosure to third parties Based on information that is specified for each operation or campaign and notified to the user. In most cases, appropriate measures will be taken under the direction and supervision of the client.
Outsourcing We may outsource the handling of personal information to outside parties to the extent necessary for the execution of each business or campaign.
2. User Registration
The registration for this service shall be completed when a prospective registrant agrees to the Terms of Use and applies for registration in the manner specified by the Company, and when the Company notifies the prospective registrant of its approval of the application.
If the Company determines that the applicant has any of the following reasons, the Company may not approve the application for registration, and shall not be obligated to disclose the reasons for such denial:
- If the applicant has provided false information when applying for registration
- If the application is from a person who has violated these Terms of Use,
- or if the Company deems the registration to be inappropriate.
3. User ID and Password Management
The User shall manage his/her user ID and password for the Service at his/her own risk.
The User may not, under any circumstances, transfer or lend his/her user ID and password to a third party, or share them with a third party. When a user logs in with the same combination of user ID and password as the registered information, the Company shall consider the use of the Service to be by the user who has registered the user ID.
The Company shall not be liable for any damage caused by the use of a user ID and password by a third party, except in the case of willful misconduct or gross negligence on the part of the Company.
4. Sales Contract
In this Service, a purchase agreement for this service shall be formed when a user makes an application for purchase to this Company, and when this Company notifies the user that it has accepted the application. Ownership of the product shall be transferred to the user when the product is delivered to the delivery Company.
2nd STORY may cancel the purchase agreement described in the preceding paragraph without prior notice to the user if any of the following events occurs.
In the event that the user violates these Terms of Use, in the event that the product delivery is not completed because the delivery address is unknown or the user is absent for a long period of time, or in the event that the Company deems that the relationship of trust between the Company and the user has been damaged. The method of payment, method of delivery, method of cancellation of purchase order, method of return, etc., for the Service shall be in accordance with the method separately determined by the Company.
5. Intellectual Property Rights
Copyrights or other intellectual property rights to product photos and other content (hereinafter referred to as “Content”) provided through the Service are the property of the Company, Content providers, and other legitimate right holders, and users may not reproduce, reprint, modify, or make any other secondary use of the Content without permission.
6. Prohibitions
The User shall not engage in any of the following acts when using the Service:
- Acts that violate laws and ordinances or public order and morals Acts related to criminal acts,
- Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in this service,
- Acts that destroy or interfere with the functions of our servers or network,
- Acts that use information obtained through this service for commercial purposes Acts that may interfere with the operation of our service Acts that may interfere with the operation of the Company’s services,
- Acts of unauthorized access or attempts to gain such access,
- Acts of collecting or accumulating personal information about other users,
- Acts of impersonating other users,
- Acts of providing benefits directly or indirectly to antisocial forces in relation to the Company’s services,

7. Suspension, etc., of the Provision of this Service
The User shall not engage in any of the following acts when using the Service:
- Acts that violate laws and ordinances or public order and morals,
- Acts related to criminal acts,
- Acts that infringe on copyrights, trademarks, or other intellectual property rights contained in this Service,
- Acts that destroy or interfere with the functions of our servers or network,
- Acts that use information obtained through this Service for commercial purposes,
- Acts that may interfere with the operation of our Service,
- Acts that may interfere with the operation of the Company’s services,
- Acts of unauthorized access or attempts to gain such access,
- Acts of collecting or accumulating personal information about other users,
- Acts of impersonating other users,
- Acts of providing benefits directly or indirectly to antisocial forces in relation to the Company’s services, and other acts that the Company deems inappropriate.
8. Restrictions on Use and Cancellation of Registration
In any of the following cases, the Company may, without prior notice, restrict a user’s use of all or part of the Service, or terminate the user’s registration:
- In the event that a user violates any of the provisions of these Terms of Use,
- In the event that any false information is found in the registration information,
- In the event that a user’s credit card is suspended as a means of payment,
- In the event that a user defaults on payment of fees and other obligations,
- In the event that a user does not respond to communications from the Company for a certain period of time,
- In the event that a user does not use this service for a certain period of time after his/her last use of this service (2),
- When there has been no use of the Service for a certain period of time since the last use of the Service, or when the Company deems the use of the Service to be inappropriate.
9. Withdrawal
The User may withdraw from the Service through the prescribed withdrawal procedure.
10. Disclaimer of Warranty and Disclaimer of Liability
The Company does not warrant that the Service will be free from defects in fact or in law (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other defects, errors or bugs, infringement of rights, etc.). (2) We do not warrant that the Service is free from defects, errors, bugs, infringements of rights, etc.
We are not responsible for any transactions, communications, or disputes that may arise between you and other Users or third parties in connection with the Service.
11. Change of Service Contents, etc.
The Company does not warrant that the Service will be free from defects in fact or in law (including safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security or other defects, errors or bugs, infringement of rights, etc.). (2) We do not warrant that the Service is free from defects, errors, bugs, infringements of rights, etc.
We are not responsible for any transactions, communications, or disputes that may arise between you and other Users or third parties in connection with the Service.
13. Handling of Personal Information
The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company’s “Privacy Policy”
14. Notification or Communication
Notification or communication between a User and MTI shall be made in a manner determined by MTI. Unless a User notifies us of a change in his/her contact information in accordance with a method separately stipulated by us, we will assume that the currently registered contact information is valid and send notices or communications to that information, which will be deemed to have reached the User at the time they are sent.
15. Prohibition of Assignment of Rights and Obligations
The User may not assign its position under the Service Agreement or its rights or obligations under this Agreement to any third party or offer them as security without the prior written consent of the Company.
16. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Philippines. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company’s head office.
